TERMS OF SERVICE

- The website available at https://photography-upgrade.com is operated by: Michał Raszka, contact email: mraszka2007@gmail.com. The service provides AI-powered digital tools for image background enhancement and generation.
- User Responsibility: You are solely responsible for the content (including prompts and uploaded images) you generate or process using this service. By using our platform, you acknowledge and agree that we act only as a technical provider and do not monitor, endorse, or verify the legality, accuracy, or quality of the content created by users. You represent and warrant that your use of the service and any content generated will comply with all applicable laws, regulations, and third-party rights (including, but not limited to, intellectual property and privacy rights). You agree to indemnify and hold harmless the service provider (the creator) from any claims, damages, or liabilities arising out of your use of the service or the content you generate.
- Disclaimer: The service is provided on an "as is" and "as available" basis. We do not guarantee that the service will be error-free or uninterrupted.
- Eligibility: By using this service, you represent that you are at least 18 years of age or have the legal capacity to enter into this agreement.

2. SERVICES AND PAYMENTS
- Access to the full features of the service requires the purchase of credit packages.
- All payments are securely processed via Stripe.
- 1 credit allows for 1 AI background generation operation.

3. REFUNDS AND CANCELLATIONS
- The service delivers digital content that is not supplied on a tangible medium.
- By clicking the "Generate" button, the User expressly consents to the immediate performance of the service before the expiry of the statutory withdrawal period and acknowledges that they lose their right of withdrawal (right to a refund) once the credit has been consumed.
- Complaints regarding the operation of the service can be submitted via email to: mraszka2007@gmail.com. Complaints will be reviewed within 14 days.

PRIVACY POLICY

1. The data controller for personal data of the users of https://photography-upgrade.com is Michał Raszka, email: mraszka2007@gmail.com.

2. User data (email address, login details) is processed solely for the purpose of providing the service, maintaining the user account, and processing payments.

3. User data may be transferred to third-party processors acting on our behalf: Supabase (database hosting) and Stripe (payment processing).

4. Users have the right to access, rectify, or request the deletion of their personal data at any time.
